2009 Important Effective Dates And Deadlines

Effective Dates:

FMLA – Employers must have begun using the revised FMLA rules on 1/16/09

OSHA - Employers must begin using the new OSHA 300-A poster on 2/1/09

Form I-9 - Employers must start using the new Form I-9 on 4/3/09

Form I-9 – Employers who have contracts with the Federal government and
are required to process Form I-9 electronically must begin using E-Verify after 4/3/2009

Genetic Information Nondiscrimination Act (GINA), (which places severe limits on the ability of a group health plan to collect genetic information or to discriminate in the setting of premiums based on genetic information and also prohibits employers from using individuals' genetic information when making hiring, firing, job placement or promotion decisions) is effective
for plan years beginning after 5/21/2009 .

Recent and approaching Due Dates:

2008 Form W-3, along with Copy A of all the Form W-2s issued to employees and former employees must be filed with the IRS, no later than 2/27/09

2008 Form 1099-R, (used to report distributions from pension or profit-sharing plans, annuities, IRAs, SEPs, or insurance contracts) must be furnished to the IRS, along with transmittal Form 1096, no later than 02/27/2009

2009 PBGC Form 1-ES (used to pay the estimated flat-rate premium is due for calendar-year, single-employer defined benefit plans having 500 or more participants) must be submitted to the PBGC no later than 02/27/2009.
